Terms of Service

These Terms govern your use of My Digital AI Empire (the "Service"), operated by Janowski Advisory Group LLC, trading as My Digital AI Empire ("we," "us"). By creating an account, activating, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

My Digital AI Empire is a platform that gives members AI-powered tools to generate branded digital products (such as PDF guides), a hosted storefront to sell them, and an optional referral program. The tools and storefront have standalone value and you are paying primarily to use them.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your login secure and for all activity under your account.

3. Billing & activation

• Activation payment: a one-time payment (currently $97) is charged to activate your account. It is charged in full at checkout.
• Monthly service: a recurring fee (currently $19 per month) keeps your storefront, tools, and automated follow-up running. It begins at signup and renews automatically each month until you cancel. You authorize us to charge your payment method on a recurring basis. You may cancel any time; cancellation stops future renewals and access continues through the end of the paid month.
• Platform fee on your sales: when you sell a product through your storefront, we retain a platform fee of 10% of the sale price and the remainder is credited to your earnings balance and paid out to you. You are responsible for your own taxes on what you earn.
• Payouts: you tell us where to send your money — a PayPal account, or a bank account. Earnings are held for a short period after they are earned, and are paid once your balance reaches the stated minimum. Earnings are paid net of transfer costs: we pay the amount shown in your account less any fee charged by the payment provider to send it. These fees vary by country and payment method, and are set by the provider, not by us.
• Prices may change with notice. Buy-now-pay-later providers have their own separate terms with you.

4. All sales are final

• The activation payment is non-refundable. Access to the Service, including its tools, products and member area, is granted immediately on payment.
• The monthly service fee: cancel any time. You can cancel from your own account at any time, without asking us. Cancelling stops future renewals. Your access continues to the end of the month you have already paid for. Part-months are not refunded, and monthly payments already taken are not refunded.
• Product purchases are final. Products bought from a member's storefront are digital goods delivered immediately and are not refundable.
• If a payment is later reversed or charged back, any referral commission paid on it is reversed, as set out in section 5.

5. Referral / affiliate program

• Members may earn referral commissions for new members who join through their referral link. Current rates: a one-time commission on the activation fee, and a recurring commission on the membership for as long as the referred member stays active.
• You must tell us where to send your money before any commission can be paid; until then earnings are held as pending. Commissions and sales earnings are paid net of transfer costs, as set out in section 3.
• Chargebacks & reversals: if a referred payment is later reversed, refunded, or charged back, the related commission is reversed and may be deducted from your current or future earnings balance.
• We may withhold or reverse commissions for fraud, self-referral, fake accounts, or abuse, and may modify or end the program at any time.
• No earnings guarantee: commissions depend on your own efforts and results. We do not promise any specific income. Nothing here is a guarantee of earnings.

6. Your products & your storefront

• Storefront sales are processed by us as merchant of record. We collect the payment, retain the platform fee, and credit the remainder to your earnings balance for payout.
• You are responsible for the products you create, sell, and deliver, including their accuracy and your compliance with applicable laws and any claims you make.
• AI-generated content can contain errors. You are responsible for reviewing what you publish.

7. Acceptable use

You agree not to use the Service to create or sell anything unlawful, infringing, deceptive, hateful, adult/explicit, or harmful, and not to misuse, scrape, or attack the platform. We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

The platform, its software, branding, and templates are owned by us. Products you generate for your own use are yours to sell, subject to these Terms and the rights of any third parties. You grant us a limited license to host and display your storefront and products to operate the Service.

9. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the prior three months.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms. Sections that by their nature should survive (payments owed, disclaimers, limitations) survive termination.

11. Changes & governing law

We may update these Terms; continued use after changes means you accept them. These Terms are governed by the laws of the State of Virginia, without regard to conflict-of-law rules.
